These two cases were consolidated for trial and appeal and arise out of an automobile accident which happened December 24, 1964, on County Trunk Highway B in Oconto county. On that day the defendant Julius C. Kempke was driving from Marinette to his home near Pound, Wisconsin, and had as passengers in his car his wife Pauline in the front seat and his daughter Elaine Vroman and her two minor children, Edith and Loyal, in the rear seat. At the time of the accident it was raining and freezing and the roads were very slippery. Such conditions had become progressively worse from the time the defendant and his passengers left Marinette. While on County Trunk Highway B the automobile suddenly slipped off the highway and came to rest in the ditch on the south side of the road. Pauline Kempke, Elaine Vroman and the child Edith Vroman were injured. While in the hospital, Pauline Kempke suffered a pulmonary embolism and died. Suit No. 186 was commenced by Elaine Vroman, as the special administratrix of her mother's estate, against her father and his insurer Heritage Mutual Insurance Company; Elaine Vroman and her husband brought suit No. 187 for recovery of their damages. A third suit commenced on behalf of the minor Edith Vroman is not involved on this appeal.
